Facebook calls in lawyers to the 'prohibición' Zuckerberg A figurine - paidContent.org

File this one under "driven by the lawyer overreach of the week." Facebook had a Chinese law firm write a "cease and desist" letter in a blog called MIC Gadget, who had the audacity to sell a figurine of Mark Zuckerberg unwise (photo to left) for $69,90.


The reason, according to cease and desist from the Charter, is that Facebook believes the figurine can "mislead the relevant public believe that you are an authorized distributor of Mr. Mark Zuckerberg and FACEBOOK or has any relationship with Mr. Mark Zuckerberg and FACEBOOK in business and law."

But owning a trademark does not mean that "own" the brand registered words or images, which only means that others are not allowed use, in Commerce, to confuse consumers. And most consumers know that Facebook does not authorize each image of them, most of what the company authorized the unflattering portrait of Zuckerberg in the Social network.


Figures like funny faces is a form of satire and comedic commentary. Chris Chang MIC gadget does not seem particularly upset by the letter of Facebook, to obtain a bit outraged by it. Since when are persons not authorized to comment on a figure so public as Zuckerberg, through art or any other means? It should be noted that the MIC Gadget made the figurine of admiration for Zuckerberg, adherents of great respect. (Ironically, if they had made a portrait more ugly and meaner, lawyers might have thought twice before leaving in.)


However, MIC Gadget has agreed to stop selling the figurine - the second had to stop after legal threats. The first was, as expected, Steve Jobs.
